Chapter 18

Run, Run, Run Around

In an attempt to add credibility to his findings, Bill solicited the services of Ron Fields, a prosecuting attorney from Fort Smith, to review the information he’d put together. According to Bill, Fields arrived at the same conclusion, that there “simply was not enough evidence to determine the time that the fatal injury was inflicted, nor the persons responsible for the injury.” Bill stated that Fields determined Charles Hackney’s credibility was poor for many reasons, but he only cited one: information obtained from an unnamed forensic pathologist who allegedly “felt that the injury occurred at the arrest site or before, and not after as Hackney had related.”

Our attorney, John Wesley Hall, requested that Bill Brazil release to the public a copy of Ron Fields’ report. Reporter Mike Masterson also requested this. Bill refused.

Years later, as I was writing this book, I had to know what was in Fields’ report that Bill did not want the public to see. It didn’t make sense for Bill not to release it if he’d quoted Fields accurately. In fact, releasing it would have bolstered Bill’s credibility. There had to be more to this story, so I decided to try to find Ron Fields. I googled Fort Smith. found his number, and called and asked if he would meet with me at his office. He agreed. It had been three decades since his last involvement in our case.

At 8:30 on a Wednesday morning Connie and I met him at his office in Fort Smith. I explained that I was writing a book to unpack the circumstances surrounding my brother’s death, including the cover-up that ensued. Since he was named as a collaborator in Bill Brazil’s twenty-page investigatory summary, I wanted to know if he agreed with the contents of that report. I told him I was not there to besmirch his character; I was there to get honest answers to specific questions.

To my disappointment, Ron Fields answered everything in broad generalities and hypotheticals, like “probably” or “that’s possible.” Unlike the other medical experts in the case, he simply was not going to give a yes or no or any clear opinion to any question. When I handed him my copy of Brazil’s investigatory summary and asked if he was familiar with it, he scanned it and said with a smile, “they took excerpts from my report, but this is not my report. Do you not have a copy? I’m sure there are some floating around.”

I told him, no, I did not have a copy of his report and that my family had made several attempts to get a copy from Bill Brazil but he refused to release it. I asked if he could find a copy of his original report and share it with us. He agreed to look, but said it was doubtful he’d kept a report like this, especially since he was now semi-retired and many years removed as a practicing prosecuting attorney.

It was clear that Ron Fields was surprised I knew as much about the case as I did.
